That has to stop, and we are pleased to see U.S. Sen. Ted Cruz stepped forward with an important piece of bipartisan legislation that would pressure tech companies to remove nonconsensual nude images — real and AI-generated — that are targeting too many people in our country, many of them girls.The legislation Cruz has proposed would make it a federal crime for a person to knowingly publish real or deepfake nonconsensual intimate images on social media or other internet platforms.
If we have a quibble with this bill, it’s that it does not go far enough by seeking to create a direct civil liability for platforms that host this sort of imagery.We understand the reason why. Cruz has advocated for reforming what is known as Section 230 of the Communications Decency Act, a provision that gives broad immunity to internet platforms for material posted on their sites.
Giving the FTC oversight to act is a workaround to the 230 problem. But whether it will be enough to spur tech companies to be more responsive to victims of this crime is hard to know. Given how indifferent these companies can be to the harm they propagate, we wonder. That said, this bill deserves to become law. Still, we urge Cruz and all legislators who support a less harmful internet to work urgently to reform the law to create the possibility of civil liability for companies that publish and host criminal material..
